' ynZ:4:b Filing of Appeals. Appeals to the Planning Commission <br /> ' nay be taken by any person aggrieved or by any officer, <br /> department, board, or bureau of the County, affected <br /> by any decision of the 4oning Officer in administering <br /> ' these regu,16icns. Such appeal shall be filed within 10 <br /> days after the date of the decision by filing with the <br /> Zoning Officer and with the Planning Commission a <br /> written notice of appeal specifying the grounds thereof, <br /> ' and by paying a filing fee, as provided in Section IX:9 <br /> at the time the notice is filed. The Administrative <br /> Officer shall forthwith transmit to the Planning Commis-; <br /> ' sion certified copies of all the papers constituting <br /> the record of said matter, together with a copy of the <br /> ruling or order from which such appeal is taken. <br /> ' YIII:4:e Action on Appeals. Action on appeal¢g shall be as <br /> provided in subsections dI Z b s,d yxiv e, octl4, <br /> ' publication as part of the regular Planning Commission. <br /> agenda shall be deemed sufficient notice. <br /> YIII:4:d Stay of proceedings. An appeal stays all <br /> pro-ceedings in furtherance of the action appealed from, <br /> unless the officer from whom the appeal is taken <br /> certifies to the Planning Commission, after the notice <br /> of appeal shall have been filed with him, that by <br /> ' reason of facts stated in the certificate a stay, in <br /> his opinion, would cause imminent peril to life or <br /> t property. In such cases, proceedings shall not be <br /> stayed otherwise than by a restraining order which <br /> may be granted by the Planning Commission or by a <br /> ' court or record on application and notice to the <br /> officer from whom the appeal is taken and on due <br /> cause shown. <br /> ' VII onditional use permit <br /> VIIL•5:a any person owning property, or having a legal interest <br /> ' in property, may apply to the Teller County Planning <br /> Commission for a conditional use permit for said <br /> property for only such uses for which these regulations <br /> ' require such a permit, subject to the requirements of <br /> this section. <br /> ' VIII:5:b Application for Permit. The applicant shall submit <br /> a written application for a conditional use permit <br /> indicating the section of these regulations under <br /> which the permit is sought, stating the grounds on <br /> ' which the permit is requested, and submitting a site <br /> plan showing the proposed development: When the <br /> application is filed, a fee as provided in Section Y111:9 <br /> ' shall be paid. <br /> 1 <br /> 36 <br />
