1) the floodplain of Fish Creek; 2) the floodplain of Foidel
Creek downstream from OSGS Gaging Station 09243900; and 3) the
floodplain of Middle Creek downstream from USGS Gaging Station
09243700.
The first subject area, the floodplain of Fiah Creek, receives
drainage from Tipple No. 3. A system of sedimentation ponds has
been installed to control the water quality of discharge from the
Tipple No. 3 area. Tipple No. 3 and the associated haulroad will
remain under the authority of the amended and previously approved
Permit No. 76-16.
The second subject area, the lover reach of Foidel Creek,

receives drainage from the Middle Creek Complea. This drainage will
be controlled and passed through a gravel filter before being
released into Foidel Creek, as shown on Map 4, Mine No. 3 Hydrology.
A small area exemption from effluent limitations has been granted
for this area. Alluvial and stream water quality and quantity on
Foidel Creek has been and will continue to be monitored by CYCC and
the IISGS.
The third subject area, the floodplain of Middle Creek,
receives runoff from the proposed surface mining area at Mine No. 3.
A large portion of the mine area upalope from effluent limitations
under NPDES Permit CO-0027154. A system of diversion ditches and a
detention basin, shown on Map 4, Mine No. 3 Hydrology, have been
constructed and maintained to prevent discharge of suspended solids
2.06-16
