<br />end occupational illnesses, es well as employment end coal production data, with MSHA, and
<br />requires operators to maintain copies of reports et relevant mine offices. The purpose of
<br />this Pert is to implement MSXA's authority to investigate, end to obtain end utilize
<br />information pertaining to accidents, injuries, and illnesses occurring and originating in
<br />mines.
<br />Part 71 of CFR 30 sets forth standards for dust, noise, sanitary toilet facilities, change
<br />rooms, sanitary, toilet facilities at surface work areas, end drinking water. These
<br />standards are spelled out in terms of the concentration of respirable dust to which a miner
<br />can be exposed and the general requirements for noise level exposure. The size, location,
<br />and number of the change rooms, sanitary flush toilets, portable toilets, showers, hand
<br />lavatories, and lockers are based on the number of employees. An adequate supply of
<br />drinking water and cups shall be provided in marked disinfected containers.
<br />Part 77 deals with the mandatory safety standards. This Part is divided into 20 subparts
<br />with sections under each subpart. The subparts listed ere Qualified and Certified Persons,
<br />Surface Installations, Thermal Dryers, Safeguards for Mechanical Equipment, Electrical •
<br />Equipment-Generel, Training Cables, Grounding, Surface Xigh-VOLtage Distribution, Lou and
<br />Medium-Voltage Alternating Current Circuits, Ground Control, Fire Protection, Maps,
<br />Explosives and Blasting, Man Hoisting, Auger Mining, Loading and Haulage, Miscellaneous,
<br />Trolley Wires and Trolley Feeder Wires, Slope end Sh eft Sinking, and Approved Books and
<br />Records.
<br />The Western Surface Agreement of 1992 between Peebody Coel Company end the International
<br />United Mine Yorkers of America provides for Xeelth and Safety under Article 11I. Article
<br />III covers: The Right to a Sefe Yorking Place, Federal Mine Safety end NeeLth Act of 1977,
<br />Mine Health and Safety Committee, access to the Mine, Reports, Safety Rules and
<br />Regulations, Cooperation in Development of Mining Plans, Preservation of Individual Safety
<br />Rights, Physical Examination, Workmen's Compensation and Occupational Disease, Safety
<br />Equipment and Protective Clothing Allowance, Maintenance, Special Safety Problem Areas, and
<br />Settlement of Xeelth or Safety Disputes.
<br />Article xIV of the Contract pertains to training. This section includes: Orientation for
<br />New Employees, General Retraining Programs, Safety Training for Specific Jobs, Maintenance
<br />Training and Rate of Pay, and General Training Provisions. •
