Auxiliary equipment such es portable drills, sweepers, <br />and scrapers, when operated more than 600 feet from equipment required to have portable <br />fire extinguishers, shall be equipped with at least one fire extinguisher. Fire <br />extinguishers shall be provided at permanent electrical installations commensurate with the <br />potential fire hazard at such installation in accordance with the recommendation of the <br />NFPA. Two portable fire extinguishers, or the equivelen c, shall be provided at each of the <br />following combustible liquid storage installations: Weer each above ground or unburied <br />combustible liquid storage station; and near [he transfer pump at each combustible liquid <br />storage tank. <br />"Firefighting equipment shall be continuously maintained in a usable and operative <br />condition. Fire extinguishers shall be examined at least once every six months and the <br />date of such examination shall be recorded on a permanent tag attached to the extinguisher. <br />One portable fire extinguisher shall be provided at each location where welding, cutting, <br />or soldering with arc or flame is performed." <br />• The 4estern Surface Agreement of 7987 of the International Union of United Mine 4orkers of <br />America also requires annual retraininc of miners in the instruction of fire warning signs <br />and firefighting procedures. <br />Seneca Caal Company is in compliance with and conducts ell required MSHA and UMYA courses <br />as stated in the law and contract, respectively. <br />Health and Safety <br />The Yoest Mine facility fells under the Federal Mine Safety and Health Act of 1977, PL <br />95-164. The Mine Safety and Health Administration, the enforcement agency, is a pert of <br />the U.S. Department of Labor. MSHA is required to inspect end enforce the Code of Federal <br />Regulations Title 30, which includes Parts 48, 50, 71 and 77. <br />Part 48 sets forth the requirements for obtaining approval of training programs and <br />specifies the type of training including new employee orientation for non-experienced <br />miners, orientation of newly employed experienced miners, annual refresher course for all <br />• miners, hazard training for non-employees coming onto mine property, and task training for <br />employees who are assigned new jobs temporarily. <br />7 <br />
