<br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER
<br />IN THE MATTER OF THE APPLICATION FOR A SECTION 112 MINING PERMIT BY GCC RIO
<br />GRANDE, INC., FII.E NO. M-2002-004.
<br />THIS MATTER came before the Mined Land Reclamation Board on August 21, 2002 at Pueblo,
<br />Colorado for hearing on objections filed against the application fora 112 permit by GCC Rio Grande, Inc.
<br />(Applicant), in accordance with C.R.S. 34-32.5-114. Paul Seby, Esquire, of Friedlob, Sanderson, Paulson &
<br />Tourtilloty LLC appeared on behalf of the Applicant. Citizen objectors {hereinafter collectively referred to as
<br />"Objectors") who appeared include: Cecil and Leona Ross, Margaret Barber, Robin Thielmier, Judith
<br />Johanson, Kathleen Wilson and Diane Hart, Daniel Dove, Charles Buller, Robert B. Cain, and Reta Zane
<br />representing themselves; Wayne Smyer representing the Pueblo Herb Society; and Debra Eiland, Esquire,
<br />representing the Citizens for Clean Air & Water in Pueblo and Southern Colorado. Stephen Brown, Assistant
<br />Attorney General, Tony Waldron, Al Amundson, and Bruce Humphries of the Division of Minerals and
<br />Geology appeared as staff to [he Board. The Board, having considered the evidence and the arguments of the
<br />parties, and having been otherwise fully informed in the premises, hereby finds and concludes as follows:
<br />1. On January 18, 2002, the Applicant applied fora 112 reclamation permit for its surface limestone
<br />quarry, located in Sections 1 S, 19 and 3Q, T22S, R64W and Sections 13, 23, 24 and 25, T22S, R65W,
<br />6'h P.M., Pueblo County, Colorado. This site is located approximately five miles south of Pueblo on
<br />property owned by the State of Colorado as well as private parties. The proposed permit area includes
<br />approximately 2,500 acres. The operation will include a road, railway, cement plant, retention ponds,
<br />and the quarry.
<br />2. The Division declazed the application complete on March 13, 2002, and commenced its technical
<br />review.
