3. Notice of the application was published four times, once a week for four consecutive weeks, beginning <br />on March 22, 2002, and ending on Aprit 12, 2002. The public comment period ended May 2, 2002. <br />4. The Division received several public comments, including sixty-nine timely objections to this <br />application. <br />5. The Division finished its technical review and sent the Applicant a Preliminary Adequacy Review on <br />May 6, 2002. <br />6. On May 30, 2002 the Board's appointed preheating conference officer conducted a preheating <br />conference pursuant to the Mined Land Reclamation Board Rules and Regulations for [he Extraction of <br />Construction Materials (hereinafter referred to as "Construction Materials Rules"), Rule 2.7.1. The <br />purpose of the conference was [o identify the parties, the issues they desired to present to the Board, the <br />witnesses and exhibits they proposed to use during the hearing, and time estimates for the hearing, as <br />well as prepare a preheazing order reflecting these matters. <br />7. Following the conference, the Board's preheating conference officer prepared the preheating order, and <br />this order was proposed to the Board at the commencement of the hearing in this matter. No party <br />objected to its contents either before or during the hearing. The Board, having reviewed the order, <br />finding its contents to be acceptable, and having heard no objections, adopted the order in accordance <br />with Construction Materials Rule 2.7. <br />8. On July 8, 2002, the Applicant responded to the Division's Preliminary Adequacy Review regarding the <br />application's technical adequacy by providing a revised application. <br />9. The Division completed its review of the revised application and determined that the application <br />satisfied all requirements of the Colorado Mined Land Reclamation Act for the Extraction of <br />Construction Materials, as well as the Board's Constmction Materials Rules. On August 13, 2002, the <br />Division made a written recommendation to the Board to approve the application, with conditions. <br />]0. The Board commenced its adjudication of this application on August 21, 2002, whereupon the Board <br />heard the following issues and made the following findings of fact and conclusions of law. <br />
