Water Quality Control Act - 20 <br />Title 25, Article 8 <br />(a) Notice shall be circulated within the geographical areas of the pro- <br />posed discharge. <br />(b) Notice shall be nailed to any person or group upon request. <br />(c) The division shall add the name of any person or group upon request to <br />a mailing list to receive copies of notices for all discharge applications within <br />the state or within a certain geographical area. <br />(4) The Cmmission shall prrnnrlgate such regulations as are necessary and <br />appropriate to provide an opportunity for public hearing, when appropriate, prior <br />to granting or denial of a discharge permit by the division. <br />Z5-8-503. PERlfITS - i+lfESi RIIaC1IRID AND lYfff•Iv Pf;~fIBITT•b. (1) The division <br />shall issue a waste discharge permit in accordance with regulations prrnarlgated <br />under this article, but only if the division has determined that all federal and <br />state statutory and regulatory requirements have been met with respect to both <br />the application and proposed permit. <br />(2) No discharge shall be permitted which will violate ans• duly promulgated <br />state, regional, or local land use plan unless all requirements and conditions of <br />applicable statutes and regulations have been met or will be met pursuant to a <br />schedule of compliance. <br />(3) No discharge shall be 'permitted which will violate a c+mtr~~l reRrr- <br />• lation unless the waste discharge permit contains Pifluent ]imitations and a <br />schedule oP compliance specifyiry; treatment. requir~nts es determined by tlx~ <br />division. Such requirements shall require the best pra~•t.ical or evaflah]e, treut- <br />ment consistent with the federal act. <br />(4) No discharge shall be permitted that by itself or in ccxnbination with <br />other pollution will result in pollution of the receiving waters in excess of the <br />pollution permitted by an applicable water quality standard unless the permit <br />contains effluent limitations and a schedule of cmpliance specifying treatment <br />requirements. <br />(5) In any case in which a permit for discharge has been applied for but <br />final administrative disposition of such application has not been made, such <br />discharge shall not be a violation of any provisions of this article or regu- <br />lations prarnrlgated under this article unless the division proves that absence <br />of final administrative disposition of such application has resulted from the <br />failure of the applicant to furnish information reasonably required or requested <br />in order to process the application. <br />25-8-504. INDIVIDUAL SEWAGE DISPOSAL SYSI'E?r6. The division shall issue <br />permits for individual sewage disposal systems in accordance with regulations <br />prarnrlgated by the carmission pursuant to section 25-8-208. Permits issued for <br />individual sewage disposal systems shall be issued under this section and such <br />permits shall be in lieu of permits otherwise required under section 25-8-502. <br />Tire terms and conditions of each permit shall be recited in full in the permit. <br />and compliance therewith shall be deernd to be full compliance with regu- <br />lations for individual sewage disposal systems permits promulgated by any unit of <br />local gover•mient within the state. The fee for such a permit shall be seventy- <br />five dollars. <br />-20- <br />
