Water Quality Control Act - 21 <br />Title 25, Article 8 <br />25-8-505. NUCLEAR, TDXIC, AND RADIOACTIVE WAST1~. (1) It is unlawful <br />for any person to discharge, deposit, generate, or dispose of any radioactive, <br />toxic, or other hazardous waste underground in liquid, solid, or explosive foam <br />unless the camiission, upon application of the person desiring to undertake such <br />activity, and after investigation and hearing, has first found beyond a reasonable <br />doubt that there will be no pollution resulting therefran or that the pollution, <br />if any, will be limited to waters in a specified limited area from which there is <br />no risk of significant migration and that the proposed activity is justified by <br />public need. <br />(Z) In such case the division may issue a permit for the proposed activity, <br />upon the payment of a fee of one thousand dollars. The division may include in <br />such permit issued under this subsection (2) such reasonable terms and conditions <br />as it may from time to time require to implement this section in a manner consis- <br />tent with the purposes of this article. The terms or conditions which may be <br />imposed shall include, without limitation, those with respect to duration of use <br />or operation; monitoring; reporting; volume of discharge or disposal; treatment <br />of castes; and the deposit with the state treasurer of a bond, with or without <br />surety as the division may in its discretion require, or other security, to <br />assure that the permitted activities will be conducted in cotnpiiance with th~• <br />teams and conditions of the permit, and that upon abandonment, cessation, or <br />interruption of the permitted activities or facilities, appropriate measures will <br />be taken to protect the caters of the state. Other than relief from provisions <br />of this article to the extent specified in this subsection (2), no permit issued <br />• pursuant to this subsection (2) shall relieve any person of any duty or liability <br />to the state or to any other person existing or arising under any statute or <br />under cumnn law. <br />25-8-506. AGRICULTURAL WASTES. (1) Neither the crnmission nor the direc- <br />tor shall require any permit for any flow or return flow of irrigation water into <br />state waters except as may be necessitated by the federal act or regulations. <br />The provisions of any permit that are so required shall not be any mare stringent <br />than, and shall not contain any condition for monitoring or reporting in excess of, <br />the minimum required by the federal act or regulations. Nothing in this article <br />shall supersede the provisions of articles BO to 93 of title 37 C.R.S. 1973. <br />(2) Neither the carmission nor the director shall require any permit for <br />animal caste on farms and ranches except as may be necessitated by the federal <br />act or regulations. The provisions of any permit that are so required shall not <br />be any more stringent than, and shall not contain any condition for monitoring or <br />reporting in excess of, the minimum required by the federal act or regulations. <br />25-8-507. PER'dIT WIvUITIONS ODNCERNING PUBLICLY O14NID SEFVAGE TREAT!~7I' WORSTS. <br />The division is authorized to inmose, as conditions in permits for the discharge of <br />pollutants from publicly owned sewage treatment works, appropriate measures to <br />establish and insure compliance by industrial users with any system of user charges <br />or industrial cost recovery required pursuant to section 25-8-705. <br />PART 6 <br />VIOLATIONS, RI~4DIES, AND PINALTIES <br />25-8-601.
