Section 816.49(h) Continued. <br />processing waste dams-and embankments covered by 30 CFR 816.91-816.93 <br />shall be certified by a qualified registered professional engineer. <br />Certification reports shall include statements on-- <br />(1) Existing and required monitoring procedures and instrumentation; <br />(2) The design depth and elevation of any impounded waters at the time of <br />the initial certification report or the average and maximum depths and <br />elevations of any impounded waters aver the past year for the annual <br />certification reports; <br />(3) Existing storage capacity of the dam or embankment; <br />(4) Any fires occurring in the construction material up to the date of <br />• the initial certification or over the past year for the annual <br />certification reports; and <br />(5) Any other aspects of the dam or embankment affecting stability. <br />Compliance with the reporting requirements of this section is <br />described in detail at Section 780.25, and summarized herein. Where <br />applicable, all impoundments have been designed and certified, and <br />will be constructed and maintained according to the criteria set <br />j forth at 30 CFR 780.25. <br />1991 <br />
