• Section 816.49(h) Continued. <br /> <br />(i) Plans for any enlargement, reduction in size, reconstruction, or <br />other modification of dams or impoundments shall be submitted to the <br />regulatory authority and shall comply with the requirements of this <br />Section. Except where a modification is required to eliminate an <br />emergency condition constituting a hazard to public health, safety, or the <br />environment, the regulatory authority shall approve the plans before <br />modification begins. <br />Plans for any future modification of dams or impoundments will be <br />submitted to the regulatory authority. No modification will begin <br />until approval of the plans has been granted by the regulatory <br />authority unless such modification is necessary on an emergency basis <br />to protect public health, safety or the environment from <br />endangerment. Such plans will be prepared and certified by a <br />i . registered professional engineer and will comply with all provisions <br />of 30 CFR 77.216, 816.46, and 816.49, as applicable. <br />Section 816.50 Hydrologic balance: Ground water protection. <br />(a) Backfilled materials shall be placed so as to minimize contamination <br />of ground water systems with acid, toxic, or otherwise harmful mine <br />drainage, to minimize adverse effects of mining on ground water systems <br />outside the permit area, and to support approved postmining land uses. <br /> <br />816-69R Revised - January, 1991 <br />
