• Section 816.46(a) Continued.
(1) Be constructed before any disturbance of the undisturbed area to be
drained into the pond; - - --
(2) Be located as near as possible to the disturbed area and out of
perennial streams; unless approved by the regulatory authority.
(3) Meet all the criteria of this Section.
~~
Mine Plan Area
A system of 12 sedimentation ponds has been planned and designed and
will be constructed and maintained in the mine plan area. Locations
of all existing and proposed sedimentation ponds are presented on Map
16a, Kerr Mine Area Surface Water Hydrology. In general, all
sedimentation ponds will be situated as near as possible to the
disturbed area. No ponds will be located within any perennial
streams, because perennial streams, as defined in 30 CFR 701.5, do
not exist within the permit area. The classification of streams
within the permit area is described in detail in Section 779.16 and
is also shown on Map 16a, Kerr Mine Area Surface Water Hydrology.
Construction of new sedimentation ponds will be accomplished before
initiating any disturbance of the area to be drained into the
respective pond. Existing ponds A, B, C, D and E have been modified
to reflect new design criteria or changes of mining and reclamation
activities within the corresponding watersheds. See the discussion
on existing structures under Section 780.12. Modification of
existing ponds took place in the summer of 1980.
A complete and detailed set of design calculations, plans and design
specifications for sedimentation ponds is presented in Exhibit 42,
Drainage and Sediment Control Plan.
816-47R
Revised - January, 1991
