• Section 816.46(a) Continued. <br />(1) Be constructed before any disturbance of the undisturbed area to be <br />drained into the pond; - - -- <br />(2) Be located as near as possible to the disturbed area and out of <br />perennial streams; unless approved by the regulatory authority. <br />(3) Meet all the criteria of this Section. <br />~~ <br />Mine Plan Area <br />A system of 12 sedimentation ponds has been planned and designed and <br />will be constructed and maintained in the mine plan area. Locations <br />of all existing and proposed sedimentation ponds are presented on Map <br />16a, Kerr Mine Area Surface Water Hydrology. In general, all <br />sedimentation ponds will be situated as near as possible to the <br />disturbed area. No ponds will be located within any perennial <br />streams, because perennial streams, as defined in 30 CFR 701.5, do <br />not exist within the permit area. The classification of streams <br />within the permit area is described in detail in Section 779.16 and <br />is also shown on Map 16a, Kerr Mine Area Surface Water Hydrology. <br />Construction of new sedimentation ponds will be accomplished before <br />initiating any disturbance of the area to be drained into the <br />respective pond. Existing ponds A, B, C, D and E have been modified <br />to reflect new design criteria or changes of mining and reclamation <br />activities within the corresponding watersheds. See the discussion <br />on existing structures under Section 780.12.
