Section 816.46(a) Continued. _ <br />Tipple Area <br />The disturbed area at the tipple drains into a sedimentation pond in <br />the northwest corner of the permit area. The pond is located within <br />the disturbed area and is designed and constructed in accordance with <br />the criteria of this Section. Design specifications for this pond <br />are provided in Exhibit 42, Drainage and Sediment Control Plan. <br /> <br />(b) Sediment storage volume. Sedimentation ponds shall provide a minimum <br />sediment storage volume equal to-- <br />(1) The accumulated sediment volume from the drainage area to the pond <br />for a minimum of 3 years. Sediment storage volume shall be determined <br />using the Universal Soil Loss Equation, gully erosion rates, and the <br />sediment delivery ratio converted to sediment volume, using either the <br />sediment density or other empirical methods derived from regional sediment <br />pond studies if approved by the regulatory authority; or <br />(2) 0.1 acre-foot for each acre of disturbed area within the upstream <br />drainage area or a greater amount if required by the regulatory authority <br />based upon sediment yield to the pond. The regulatory authority may <br />approve a sediment storage volume of not less than 0.035 acre-foot for <br />each acre of disturbed area within the upstream drainage area, if the <br />person who conducts the surface mining activities\ demonstrates that <br />sediment removed by other sediment control measures is equal to the <br />reduction in sediment storage volume. <br />816-48R Revised - January <br />
