6.4.8 EXHIBIT H -Wildlife Information <br />39. The applicant has specified that they have contacted the Colorado Division of Wildlife and the US Fish <br />& Wildlife Service to verify that no state of federal threatened or endangered species or any other species <br />of special concern reside on the proposed quarry site or in its vicinity. Please provide any written <br />correspondence you may have from representatives of either agency which verifies this assertion. <br />6.4.12 EXHIBIT L -Reclamation Costs <br />40. In confomtance with Rule 6.4.12(1), please revise the reclamation cost estimate to include the <br />following itemized costs: <br />drill Rc blast 1 full sequence of a typical quarry blast to achieve highwalUbench sequence <br />backfilling & grading of quarry, shot rock from typical quarry blast <br />typical dust control requirement fora 2-3 month period <br />mob/demob reclamation equipment (include list of reclamation equipment) <br />6.4.13 EXHIBIT M -Other Permits and Licenses <br />41. Colorado Land Reclamation Act for the Extraction of Construction Materials (CLRA) regulation <br />1.4.1(5)(d) requires that you state that you have `applied for all necessary approvals from local <br />government.' in your adequacy response of Mazch 23, 2005, and your counsel's Mazch 16, 2005 <br />memorandum regazding the special use review (SUR) process and the highway access permit process, you <br />have acknowledged that you will need to obtain these pemuts prior to beginning mining operations within <br />your proposed permit area. Gilpin County has indicated in a letter from Tony Peterson and the county's <br />attorney that you have not yet initiated the SUR process, that the highway access permit you obtained from <br />the Colorado Department of Transportation has expired, and that Gilpin County now has authority to issue <br />this permit. Pursuant to the requirement of CLA Rule 1.4.1(5)(d), please address whether you aze seeking <br />an SUR permit and a highway access permit from Gilpin County. <br />42. In conformance with Rule 6,4.13, please provide a statement identifying which permits, licenses and <br />approvals the Applicant holds or will be seeking in order to conduct the proposed mining and reclamation <br />operations. <br />6.4.19 EXHIBIT S -Permanent Man-made Structures <br />43. The Applicant has indicated that it is their intent that the affected area, including the main access road, <br />will be kept at least 200 feet distant from all permanent man-made structures until Rule 6.4.19 has been <br />satisfied with respect to each stmcture. In conformance with Rule 6.4.19, please provide either revised <br />Mine Plan and Reclamation Plan Maps which show that the affected acreage boundary is at least 200 feet <br />away from any permanent, man-made stmcture; or <br />if the affected azea will be within 200 feet of any permanent man-made stmcture, for each such <br />structure, provide a notarized agreement between the Applicant and the person(s) having an <br />interest in the structure, that the Applicant is willing to provide compensation for any damage to the <br />structure. (Where the stmcture is a utility, the Applicant may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that the mining and reclamation activities, as proposed, will <br />
