EXHIBIT D (CONTINUED) <br /> The slurry wall will be installed to encompass Areas 2A, 3 , 4 , and <br /> 5 . The exact location of the slurry wall along the "South Platte <br /> River Berm Area" will be determined by agreement with the Urban <br /> Drainage and Flood Control District, and the State of Colorado <br /> Division of Water Resources and/or Water Court on water rights <br /> issues . Prior to installation of the slurry wall, the agreements <br /> will be submitted to the Division of Minerals and Geology. The <br /> most probable location of the slurry wall is shown on MINING PLAN <br /> MAP, EXHIBIT C-2 . <br /> It is anticipated that most of the material will be transported by <br /> conveyor belt to the existing plant north of the South Platte <br /> • River, which traverses Areas 1, 2A, 2C, 3 , 4, & 5 . Cooley will <br /> retain the right to process the material on-site and transport it <br /> off-site by truck, if necessary. Processing equipment would <br /> consist of a crusher, screens, washer, and conveyors . There may <br /> also be temporary ponds, for settling and recycling, and a scale <br /> house and small office might be set up at either of the two truck <br /> • access points . <br /> In the event some of the material is transported directly from the <br /> site by truck, the primary haul route for transport of material <br /> from the site will be 88th Avenue and Monaco Street to I-76 for use <br /> in other parts of the metropolitan area. Other routes may also be <br /> used for local deliveries and destinations northwest and north. <br /> The operation will normally operate from 6 : 00 A.M until 10 : 00 P.M. <br /> six days a week, although extended hours and work on Sundays and <br /> Holidays may occur during extremely busy periods . Hauling would be <br /> allowed between the hours of 6 : 00 A.M. to 6 : 00 P .M. Monday through <br /> Friday and 8 :00 A.M. to 5 : 00 P.M. on Saturday, unless longer hours <br /> are granted by Commerce City, which is the local government with <br /> jurisdiction. <br /> To summarize, the Mining Areas are as follows : <br /> Area 1 - 5 Acres <br /> 2A - 44 Acres <br /> Area 2B - 34 Acres <br /> 2C - 23 Acres <br /> Area 3 - 35 Acres <br /> Area 4 - 17 Acres <br /> Area 5 - 22 Acres <br /> Total 180± Acres <br /> • <br /> • <br />
