I <br /> EXHIBIT D (CONTINUED) <br /> The excavation will proceed from south to north and east to west in <br /> the phases as shown on the accompanying MINING PLAN MAP, EXHIBIT C- <br /> 2 . Except for installation of the slurry wall, no excavation shall <br /> occur within 25 ' from adjacent property lines . <br /> Some areas , as is explained in the next paragraph, will have <br /> special setback requirements for any excavation. Except for those <br /> areas mentioned in the next paragraph, mining from the minimum 25 ' <br /> setback requirement may be undertaken vertically. Immediately <br /> after excavation, all vertically mined areas must be backfilled no <br /> steeper than a ratio of 2 : 1 (horizontal to vertical) , except from <br /> 5 ' above the expected water line to 10 ' below the expected water <br /> line where slopes shall not be steeper than 3 : 1 slope . <br /> Special setback, sloping, and mining requirements shall apply in <br /> following areas : <br /> 1 . Along Monaco Street and 88th Avenue, and within 200 ' of any <br /> • adjacent man made structure, no vertical mining will be <br /> allowed from the 25 ' setback line . A temporary 1 : 1 mining <br /> slope shall be allowed, provided any slope within 200 ' of the <br /> man made structure is immediately backfilled to the previously <br /> mentioned above standard after mining has been completed in <br /> these areas . <br /> 2 . Along the Wyco pipeline, no mining shall occur closer than 50 ' <br /> on either side of the centerline of the pipeline . Sloping <br /> shall not be steeper than 3 : 1 . <br /> 3 . From the center of the Bull Seep Ditch, no excavation shall <br /> occur closer than 50 ' on either side of centerline of the <br /> Ditch. All Sloping shall not be steeper than 3 : 1 . <br /> 4 . All mining, including sloping, final elevations, improvements, <br /> etc . within the "Area 2C - South Platte River & Berm Area" <br /> (400 ' of centerline of present channel) shall be subject to <br /> • approval of the UD&FCD. <br /> Prior to beginning extraction, 6 ' chain link fencing will be <br /> installed where necessary to prevent access to the site. Where <br /> natural barriers, such as the South Platte River exist, no fencing <br /> will be installed. in areas where adjacent property owners have <br /> installed fencing, Cooley' s fence will simply connect to the <br /> existing fencing. Two gates will be installed, one onto 88th Avenue <br /> and one onto Monaco Street at the proposed Truck Access Points . <br /> Both are shown on MINING PLAN MAP, EXHIBIT C-2 . <br />• <br />• <br />
