Preliminary Tozieity Investlaation (Oucfalls 00?, 011 and 012) <br />If directed by the Division, the permSttee shall perfon a preliminary <br />toxicity investigation. The permSttee will have 15 working days from <br />the date of Division pacification to complete a orellminary toxlnl[y <br />investl~acion and sulanit the results co the Division, 1n writing. The <br />pr ellminary to xicicy investigation may include, but is nac Llniced ta: <br />additional chemical and biological monitoring, examination of <br />precreacmenc prograa records, examination of discharge monitoring <br />reports, evaluation of treatment processes and chemical use, inspection <br />of material storage and transfer areas to determine if a spill may have <br />occurred, and similar procedures. <br />I: the preliminary toxicity investigation identifies a probable tozicant <br />and/or a probable source of Cozicity, the permictee shall sultnlt, as <br />part of Its final report results, written notiEicacion co that effect to <br />the Division. Within 30 days of completing the preliminary tonicity <br />investigation, the permictee shall submit for rite Division's approval a <br />control program co control effluent to xicicy, and shall proceed to <br />implement such plan within 7 days following approval by the Division. <br />l• <br />I° no probable explanation for toxicity is identified in the 15-day <br />preliminary to xieity investigation, a Phase I Toxicity Seduction <br />Evaluation (TEE) is required. The permictee shall notify the Division, <br />as part of its final report, of its intent to proceed with cne Phase I <br />TEE. <br />I. Cozicity disappears during the preliminary toxicity Snvestlgatlon, <br />the permittee shall suh~ic written nociflcacion co that effect to the <br />Division. The Division may require the permictee to conduct accelerated <br />testing to demonstrate the continued absence of co xicicy. Ii no acute <br />tonicity is found to esisc, the toxicity incident is closed. <br />6. Phase I T2E (Outfalls 002, O11 and 013) <br />The Ehase I TEE performed by [he permictee shall be in general <br />accordance with ttethods for Toxielty Seduction .valuations, Phase I, <br />Toxicity Characterltatloa Procedures (Draft - June 24, 1988 published <br />by SPA, or in accordance with procedures approved by the Division. IE <br />only one species demonstrated eoxieity during accelerated testing, then <br />that species alone may be used Sn the Phase I Tit_°.. The permittee has 45 <br />days Prom the submission of the final report on the preliminary toxicity <br />investigation to complete the Phase I TRr and submit a report to the <br />Division on the results of the study. <br />~. <br />IE. the Phase Z TRy identifies a probable toxicant and/or a probable <br />source of toad city, the permictee shall submit written noclfieation to <br />that effect to the Division as part of the report. Within 30 days of <br />camplec!ng cite Phase Z TSE, the permittee shall submit for the <br />Division's approval a control program to control 1dc.T, and shall proceed <br />to implement such plan within 7 days following approval by the Division. <br />
