4) Recycle materials are noted within the Mining Plan under 6.4.4 and within the <br />Reclamation Plan under 6.4.5. The Reclamation Plan clearly states what the applicant <br />will require of individuals and companies bringing in the materials. However, ultimately it <br />is the operator who must certify with the Division that the material is inert. The notice <br />~ecified in Rule 3.1.5 (9) must be submitted for this backfill importation and placement. <br />5) The Mining Plan lists a very good seed mix for topsoil and overburden stockpile <br />erosion protection. Please clarify in pls/acre the quantities of each Grass species <br />noted. <br />6) The Mine Plan denotes that overburden and topsoil stockpiles will be separate as is <br />required. However, The Mining Map only denotes where topsoil stockpiles will be <br />located. Please note on the Mining Map the general location of overburden <br />stockpiles. <br />7) Within the Mining Plan it is first noted that the resource is situated above stony /clay <br />loam. Later, it is referenced that mining will occur in a single lift to the underlying bedrock <br />stratum. Please clarify the applicant's intent. Is it to mine down to the stone /clay loam <br />layer or to the bedrock? If the intent is to mine to bedrock, please submit a commitment <br />by the applicant to remain a minimum of two (2) feet above any shale formations to <br />reduce the risk of a selenium release issue. <br />8) The Reclamation Plan states that "at least 8 inches of topsoil will be replaced on <br />reclaimed areas. Soil profiles and text submitted state 0 to 6 inches are currently <br />on site. How does the applicant intend to supply additional topsoil to cover the <br />deficit? Staff recommends stating a range of topsoil placement of 6 to 8 inches to <br />insure that there is some room for error in estimations of available quantities per <br />Rule 6.4.5(1). <br />9) Within the Reclamation Plan, please address the installation of erosion fabric noted on <br />the Reclamation Map. The Division needs to know what type of fabric is to be used, an <br />what methods will be employed to install it. <br />10) Within Exhibit G, Water, the applicant has supplied documentation for shares of the <br />Kannah Creek Highline Ditch. Please clarify that these shares entitle the applicant <br />to retain water on site or that stormwater will be released within 72 hours of <br />retention. <br />11) Staff has received the Division of Wildlife's response for comments concerning this <br />application. Please address the D.O.W.'s request for the addition of Cicer Milkvetc <br />the final seed mix. <br />12) Exhibit H, Wildlife does not meet the requirements of Rule 6.4.8(a)(b)(c) or (d). Please <br />submit the required information. <br />
