I~ <br />J <br />Mr. Steve Manger <br />Office of Surface Paining <br />1500 Brooks Towers <br />Denver, Colorado 80203 <br />Dear Mr, Manger: <br />~`\ <br />May 13, 1982 <br />Wyoming Fuel Company constructed the emergency spill~aay for <br />Pond 41 as shown on the September 14, 1981 version of Figure 2 <br />in Wyoming Fuel Company's Canadian Strip Paine Permit Application. <br />The principal spillway designed is not constructed as shown <br />on the above Figure. On April 15, 1982 Plike Y.olin of Wyoming Fuel <br />Company talked to Richard llomingue of the CMLRB and it was decided <br />that the principal spillway could be adjusted by punching holes at <br />• the required i~itake level. when water levels lower and conditions <br />permit, a modification of the spillway will be made by cutting the <br />spillway with a torch. This telephone conversation was confirmed <br />by a letter to P7r. Domingue from P1r. P.olin on April 15th. <br />This should eliminate any further concerns the OStd has regard- <br />ing stipulations not met by 47yoming Fuel Company. It is my undez- <br />standing that this is the final information you need before 1Pyoming <br />Fuel Company will receive the Fermat Application for the Canadian, <br />Strip Mine for signature from the OSM. <br />Sincerely, <br />DMS/tl <br />David P1.
