Section 816.23 (b) Continued.
• broadcast seeded. Planting shall be done either in the spring or
fall planting periods as discussed in Section 816.113.
A straw mulcher will also be utilized for topsoil stockpile sideslope
stabilization if the broadcasting seeding proves unsatisfactory.
The past experience of Energy Fuels indicates that vigorous annual
grains are highly effective in stabilizing topsoil stockpiles and
there is no reason to assume they will not continue to effectively
stabilize stockpiled topsoil.
In addition to the stabilization afforded by the planted grasses,
volunteer growth, and mulch (if necessary), all topsoil stockpiles
will have diversion ditches constructed around them if there exists
a possibility of erosion from surface water flow.
Removal of any of the proposed or existing topsoil stockpiles and
• their subsequent stockpiling is not part of the proposed topsoiling
plan and will not be done.
Section 816.24 Topsoil: Redistribution.
(a) After final grading and before the replacement of topsoil and other
materials segregated in accordance with Section 816.23, regraded land
shall be scarified or otherwise treated as required by the regulatory
authority to eliminate slippage surfaces and to promote root penetra-
tion. If the person who conducts the surface mining activities shows,
through appropriate tests, and the regulatory authority approves that no
harm will be caused to the topsoil and vegetation, scarification may be
conducted after topsoiling.
After the final grading described in Section 816.102 is completed,
the topsoil will be reapplied to the thickness outlined in the
Eckman Park Topsoil Removal, Storage, Redistribution and Revegeta-
tion (Map 42) and Energy Alines No. 1 and 2 Topsoil Removal,
816-17
