Kerr also agrees to construct the relocated portion of <br /> Jackson County Road 12 East in accordance with the "DECISION/RIGHT- <br /> OF-WAY GRANTED" (Grant No. Colorado 29939-RW) which was prepared by <br /> the Bureau of Land Management and which sets forth various stip- <br />~° "` ~- °`-=~ -~ ~ ~ ~ ~ ulations and conditions regarding the relocation of Jackson County <br />--'- Road 12 East and the reclamation of that portion of Jackson County <br />~= '~-- _ -~. .- - '. Road 12 East which will be abandoned upon completion of the relocation. <br />.... ._ -. ._ . ~ ...i <br />-."-.- A copy of said right-of-way grant is attached hereto, marked as <br /> Exhibit "C", and incorporated herein by reference as if fully set <br /> forth. <br />~~ ~~ - -~- 7. Rerr agrees to provide continuous and uninterrupted access <br /> over and across the existing County Road 12 East during the con- <br />. struction stage and until the relocation is completed. Upon com- <br /> pletion of the relocation, Kerr agrees to reclaim or provide for <br />- the reclamation of that portion of the existing County Road 12 East <br /> <br />,. which will be abandoned and vacated ~.pon completion of the <br />• ~ ~ ~ relocation. Aowever, if certain portions of the existing County <br />' <br /> s mining operations for use <br />Road 12 East are incorporated into Rerr <br /> as haul roads, then reclamation of such portions by Kerr shall be <br /> accomplished in accordance with all special stipulations pertaining <br />- _ - - to the abandoned roads as those, special stipulations are set forth <br /> in Exhibit "C". <br /> 8. On or before October 1, 1980, County agrees to erect a <br /> permanent wire livestock fence designed for use on antelope ranges <br /> between points F and G on Map 1 of Exhibit "C". County also agrees <br /> to remove that portion of the existing fence between points R and I <br /> <br /> on Map 1 of Exhibit "C' on or before October 1, 1980. <br />. 9. On or be'_ore October 1, 1980, Rerr agrees to erect a <br /> permanent wire livestock fence designed for use on antelope ranges <br /> between points A and B on Map 1 of Exhibit "C", together with gates <br /> at points C, D and E on said Map 1 of Exhibit "C". Kerr also <br /> agrees to erect said fence in accordance with any other stipulations <br /> or conditions contained in Exhibit "C". <br />• 10. Prior to or simultaneously with the execution of this <br /> Agreement, Kerr agrees to furnish County with a Deed of Easement <br /> from Marr Company to the County of Jackson, State of Colorado.
