• A copy of the survey depicting the above-referenced tract and road <br /> location is attached hereto, marked as Exhibit "A", and incorporated <br /> herein by reference as .f fully set forth. ~ . <br /> 2. In exchange for road maintenance services which Herr has <br /> previously provided and will continue to provide on portions of <br />y Jackson County Road 12 East, County agrees to provide any and all <br /> pit run gravel necessazy to accomplish the construction of the <br /> relocated portion of Jackson County Road 12 East. Said sand and <br /> gravel will be provided from a tract of land located in Section 20, <br /> Township 9 North, Range 75 West, of the 6th Principal Meridian, <br />. ~ Jackson County, Colorado, and, in accordance with the Free Use Permit <br /> issued by the Bureau of Land Management, Department of the Interior, <br /> all sand and gravel provided by County to Kerr shall be used solely <br /> on County roads and rights-of-way as mutually agreed to by the <br /> parties. <br /> 3. County agrees to provide, at its own expense, twenty-five <br /> hundred cubic yards (2,506 cu.yd.) of three-quartci inch (3/4") minus <br />• crushed gravel and twenty-five hundred cubic yards (2,500 cu.yd) of <br /> one and one-half inch (1-1/2") minus screened gravel for this project <br /> and agrees to have said gravel available in a stock pile at the <br /> gravel pit site referred to above. Kerr expressly understands and <br /> agrees that crushing and screening operations shall be operated and <br /> supervised by County personnel only. <br />~~~~ ~ ~ 4. Kerr agrees to provide any and all labor and/or equipment <br />- ~ necessary to load and transport any pit run gravel from the gravel <br /> pit site to the road construction site. County agrees to locate the <br />-'-w~=v.;y-:-~ e.,~--T-----.,..~.. - crushing operation on the gravel pit site referred to in paragraph 2 <br /> above. In addition, Rerr agrees to load and transport any crushed <br /> materials from the site of the crushing operation to the road <br /> construction site. <br /> 5. Rerr agrees to construct the relocated portion of Jackson <br /> County Road 12 East in accordance with the Jackson County Road Stan- <br /> dazds and Specifications and all construction shall conform to such <br /> minimum standard; however, the parties may mutually agree in writing to <br />• the imposition of higher road standards and specifications.
