~t <br /> <br /> <br />of royalty hereunder shall be available to Lessors or any agent <br />designated by them at all reasonable times. <br />4. Royalties shall be due and payable on or before the <br /> <br />tenth (10th) day of the calendar month following the calendar <br />month in which gravel, rock, sand and earth are removed from <br />the Leased Premises. <br />5. Nielsons shall pay annually a minimum rental and <br />royalty of ~'~~~„_ ~'~~ ... ,.;~ Dollars ($_a,(.'~' ) <br />per year. Such minimum royalty shall be payable at the end of <br />each lease year, and to the extent actual royalty has been paid, <br />such actual royalty payment shall be a credit against the mini- <br />mum royalty. The first lease year shall expire on Dfay 31, 1976 <br />and each subsequent year shall expire on the succeeding last <br />day of May in each year. In each lease year commencing June 1, <br />1976, and on each June 1 thereafter during the term hereof, the <br />royalty per yard and the minimum annual royalty shall be increased <br />five per cent (5%). <br />6. Lessors shall have the right at any time to terminate <br />the lease on Parcel "B" by thirty (30) days' written notice to <br />Nielsons. Such termination shall not affect the minimum royalty <br />payable hereunder. <br />7. Except for the purpose of designating an access into <br />Parcel "B," Nielsons shall be solely responsible for the deter- <br />urination and location of access to each of the parcels hereunder <br />and such access shall be at the sole cost and expense of Nielsons. <br />8. Nielsons agree to save, hold and indemnify Lessors <br />harmless of and from any claims, demands, liabilities or expenses, <br />including reasonable attorney's fees, as a result of injury to <br />or death of persons or damage to property other than the Leased <br />Premises resulting from Nielsons' activities upon the Leased <br />Premises. <br />9. Nielsons shall purchase and maintain public liability <br />and property damage insurance, insuring both Nielsons and Lessors <br />-3- <br />
