zi <br />WHEREAS, the parties desire to enter into a Gravel Lease <br />of Parcels "A," "B" and "C" as herein specified; <br />NOW, THEREFORE, in consideration of the premises and of <br />the covenants herein contained, it is agreed: <br />1. The above described premises, Parcels "A," "B" and <br />"C" are hereinafter referred to as the "Leased Premises." Les- <br />sors hereby lease, let and demise to Nielsons the exclusive right <br />to excavate, remove, store, stockpile, market, sell or otherwise <br />dispose of gravel, rock, sand and earth from the Leased Premises. <br />In addition, Lessors grant Nielsons the right to use the Leased <br />Premises for the purposes of erecting and installing any and all <br />necessary asphalt plants, crushing plants, excavation equipment, <br />rock crushing equipment, scales, loader and any other equipment <br />necessary, useful or associated with removal and crushing of <br />gravel and rock deposits and the production of gravel, sand or <br />gravel products. Nielsons shall have the right of ingress and <br />egress to and from Parcels "A" and "C" at such locations from <br />public roads as they shall elect. Access to Parcel "B" shall be <br />determined at a location to be hereafter designated by Lessors. <br />2. The term of this Lease shall be for five (5) years <br />from the effective date hereof unless sooner terminated as pro- <br />vided herein. <br />3. Nielsons agree to pay to Lessors royalties hereunder <br />for gravel, rock, sand and earth removed from the Leased Premises <br />in the amount of thirty (30) cents per cubic yard; however, the . <br />parties agree that the determination of the volume of gravel may <br />be made by weighing the same with each ton equivalent to two-thirds <br />(2/3) of one (1) cubic yard. All gravel, rock, sand and earth <br />removed from the Leased Premises shall be weighed upon scales of <br />Nielsons installed upon the Leased Premises, and a record made <br />thereof. Nielsons hereby state that such scales are accurate and <br />will be maintained by Nielsons so that such scales continue to be <br />accurate.
