Exhibit Page 56

Structure Description/notes Owner
Water ditch The Home Ditch is an irrigation ditch carrying water Landowner
diverted from the Dolores River approximately 6,000 feet
upsteam from the proposed mining site, and carri0s 2.5 to
4.5 cfs of water for irrigation of the cropland to be mined.
The ditch within 200 feet of the proposed mining site
consists of an unlined ditch approximately 48 inches wide
and 24 inches deep, with an irregular cross section but
generally trapezoidal.
Evaluation The ditch requires maintenance on a constant basis when in use to keep clean of
silt, vegetation, and debris. The ditch is uphill from all mining activities, and located
20 feet or more from the permit boundary, and 60 feet or more from the edge of the
pit, separated by the 40-foot buffer zone with topsoil stockpiles. Based on the soil
conditions and terrain, no impact on the stability or functionality of the ditch is
anticipated.
The ditch discharges into a number of lateral ditches which carry water to the
cropland, which will be removed during mining, and replaced during reclamation with
lateral ditches to feed the ponds established as part of reclamation. The ditch will be
used during mining operations to transport water for washing of product, dust
control, and reclamation.
Photo 2.
