Sediment removed from the sediment pond cannot be assumed <br />to be a suitable soil material. Therefore, Bear should <br />submit a plan for disposal of the material if analyses <br />• show that it is not suitable soil material. <br />Mitigation: Bear Coal Company has analyzed soil samples <br />from the Bear No. 3 sediment pond. These analyses have <br />been submitted to the Division for review. The results <br />are included in Exhibit 23, Bear No. 3 Mine, Topsoil <br />Plan. <br />3. Bear Coal Company should submit a technical revision <br />deleting from their permit the portions of the Bear No. 1 <br />and No. 2 reclaimed areas which have been taken over by <br />West Elk Coal Company. Partial bond release, in <br />accordance with Rule 3.03 may be pursued for Bear No. 1 <br />and No. 2. <br />Mitigation: Bear Coal Company has submitted a technical <br />• revision to the Division in the form of Exhibit 25, Bear <br />-3- <br />
