<br />Exhibit E -Reclamation Plan (continued) <br />• consist of material that complies with the definition for "Inert Fill" contained in the Health <br />Department regulations, Seaton 1, and non-toxic, non-acid forming material according to Division <br />regulations. This includes but is not limited to earth, sand, gravel, rock, aged concrete, masonry, <br />and asphalt fragments. B&B will comply with State Health Department Regulations regarding a <br />Certificate of Designation, if an offsite source of fill is used. There are no acid-forming or toxic <br />materials involved in this operation and blasting is unnecessary on this site. There are will be no <br />drill or auger holes on the site, nor will blasting be used at any time. Maximum slopes will be <br />within the limits set forth in the Rules and Regulations of the Board and will be capable of being <br />traversed by machinery. <br />Due to measures taken by the operator, it is not expected that prevailing hydrologic conditions will <br />be disturbed. The operator will comply with applicable Colorado water laws and regulations (as <br />the operator understands them) governing injury to existing water rights. We plan to minimize any <br />disturbance that might occur to the prevailing hydrologic balance of the affected land and sur- <br />• rounding area and to the quality of water in surface and groundwater systems both during and after <br />the mining operation and during reclamation. In addition, the operator expects to comply with <br />applicable Federal and Colorado water quality laws and regulations. Any water used in the <br />operation of the processing plants and gravel pit will come from 362 acre-feet of water negotiated <br />for use by B&B on the site. <br />There are no dredge facilities at this site and there will be no earthen damson the site. There are no <br />temporary siltation structures involved in this operation that have to be removed. Two sediment <br />sumps will also be used as settling ponds for recycling wash water and will become integral parts of <br />the overall drainage plan to control process water during mining. These ponds will collect and <br />retain process water and storm water as needed. <br />The mining and reclamation plans take into consideration existing wildlife conditions. We have <br />addressed all concerns in the Wildlife Statement provided by the CDOW and we have incorporated <br />. all of their suggestions into the mining and reclamation plan. In fact, the entire permit area was <br />Carol Ann Permit CDMG Applicazion 3 3 <br />
