j. There are no water sources such as lakes, streams, springs, stock water ponds, <br />ditches, reservoirs, and or aquifers on or around the proposed mining area. <br />There are no wells located within 1000 feet of the site. Due to the soil and little <br />or no slopes, there will be little to no storm water runoff. We will not be storing <br />any of the storm water runoff, therefore, we will not interfere with any irrigation <br />or water well rights. <br />k. We do not expect to come in contact with any toxic, or hazardous materials <br />while in the process of mining. If for some unforeseen reason we do come in <br />contact with any toxic or hazardous materials, we will notify the division of the <br />issue and take the proper steps to contain the toxic or hazardous material, so as <br />not to further disturb nor damage the proposed mining area and or the <br />surrounding areas. All equipment will be self-contained, so as to no harm any of <br />the vegetation or wildlife, or to deface any of the land on or around the <br />proposed mining area. All refuge will be contained and disposed of in a proper <br />manner, for the purpose of keeping the proposed area clean and to control the <br />unsightliness. Being there is no drainage, nor any source of drainage system on <br />or around the proposed mining area, there will be no problem keeping the <br />drainage system clear of pollution. <br />I. No water will accumulate on or around the proposed mining area because of the <br />composition of the underlying shale seam. Consequently, we do not expect to <br />affect the hydrologic balance of surface or ground water resources in the area of <br />injury. It is this contractors opinion that there will be little to no off-site damage. <br />We do not plan on disturbing any of the area around the proposed mining site, <br />excluding the grading and graveling of the access and county roads. Although <br />grading is a must to keep the road in good driving condition, it should provide no <br />new damage to any of the area. Please refer to Exhibit D for any question <br />pertaining to the reclamation and future use of the land. <br />m. This will be an open gravel pit operation, with our main commodity being road <br />base. This gravel pit will be approximately 9.98 acres, and located <br />approximately 10 miles Northeast of Walsenburg, Colorado, which is to the east <br />of a county road. <br />The initial preparation of the surface before extraction of the sand and gravel will <br />consist of stripping the vegetation and topsoil and placing it in stockpiles for use <br />later during reclamation. Front-end loaders, scrapers, and motor graders may be <br />employed for this phase. <br />
