As you know, <br />we are required to obtain your comments concerning our augmen- <br />tation plan as part of the permit process. <br />Briefly, our water requirements will be those necessary <br />to batch concrete, clean equipment and replace evaporation loss- <br />es of ponds created in the mining area. We have discussed the <br />situation with the Division Engineer in Pueblo and the Pueblo <br />water Board. Thffy indicated that water is available for pur- <br />chase and that Statute 37-80-120 would be the proper vehicle to <br />supply our needs. Therefore, we intend to purchase rights to <br />water to return to the Arkansas River the amount depleted from <br />the basin due to evaporation and our consumptive use. <br />Our needs for the plant operations will be tentatively <br />supplied by an irrigation well in Section 36, Township 20 South, <br />Range 63 West known as Well N11, Case W-244(1) owned by Rich <br />and Company. We propose to meter this water and either obtain <br />our own rights to trans-mountain water or purchase the water <br />from the Pueblo Water Board. We do need to know those steps re- <br />:!uired to authorize this point of diversion. <br />
