For rainfall to waive TSS and total iron limitations, it is necessary to prove that dischazge occurred within 48 hours after <br />measurable precippitation has stopped. In addition, to waive settleable solids limitations, it is necessary to prove that discharge <br />• occurred within 48 hours after precipitation greater than the 10-year, 24-hour event has stopped. <br />b. For snowmelt, [o waive TSS and total iron limitations, it is necessary to prove that discharge occurred within 48 hours after pond <br />tflow has stopped. In addition, to waive settleable solids limitations, rt is necessary to prove that discharge occurred within 48 <br />hours after pond inflow volume greater than the ] 0-year, 24-horn event has stopped. „ <br />Should a precipitation event or snowmelt occur, the permittee shall submit adequate proof in order for an exemption to be claimed. <br />Weather station data may be apppro riate in making this demonstration. Said proof shall be submitted as an attachment to the <br />Discharge Monitoring Report {DMR~for the appropriate period. The Division shall determine the adequacy of proof. As part of this <br />determinanon, the Division shall evaluate whether the permittee could have controlled the dischazge in such a manner that primary <br />limitations could have been met. All manual dewatering of ponds that are equipped with automatic dewatering systems must meet <br />TSS and total iron limitations. If a pond has only manual dewatering capability, relief is available only to the extent required to <br />regain necessary stability and capacity. <br />3. Post-Minine Areas <br />In conformance with 40 CFR 434.50, commencing at the time active mining has ceased and all surface areas served by a <br />sedimentation pond have been returned to the requued contour and revegetation has commenced, applicable discharges may be <br />eligible for post-mining limitations. In most cases, these post-mining limitations shall remain in effect until bond release. The <br />permittee shall notify the Division at the appropriate time so that consideration of permit modifications can be made. Prior to <br />notification and subsequent permit modification, active mining limitations will apply regazdless of actual mine status. <br />4. Compliance Schedule(s) <br />a. Final Total Recoverable Ixon Lunitations: The peimittee shall achieve compliance with the final effluent limitations for total <br />recoverable uon of art .A.1. ., e ective January 1, 2008, in accordance with a schedule of compliance approved by the <br />Division. <br />i. The perrnittee must, by June 30, 2005, submit a plan for approval that identifies operational changes, modification of [he <br />existing treatment system, or constmction of a new treatment system. A schedule of dates to accomplish various tasks <br />related to the plan should also be included such that compliance with the final Total Recoverable Iron limitations may be <br />attained, <br />• ii. The pertitittee must, by December 31, 2005 and December 31, 2006, submit progrgress reports summarizing the progress in <br />implementing the plan such that compliance with the final Total Recoverable Iron liitations maybe attained. <br />iii. The perxnittee must, by December 31, 2007, submit study results that show compliance has been attained with the final Total <br />Recoverable Iron limitations maybe attained. <br />Upon approval of the implementation plan by the Division, all terms and conditions of the implementation plan, including but <br />not ]tauted [o the compliance schedule, will automatically become conditions of this permit. <br />Progress reports must be submitted for tasks identified in the above schedule. Refet to Part I, Section D, Reporting <br />Requuemenis, for specific information. <br />No later than 14 calendar days following each date identified in the above schedule of corttpliance, the petrtittee shall submit <br />either a report of progress or, m the case of specific actions beingg required by identified dates, a written nonce of compliance or <br />noncompliance, any remedial actions taken, and the probability of~meetmg the next scheduled requirement. <br />A schedule for the elimination of the discharge, through connection to another treatment system or by other means, maybe <br />substituted for this schedule of upgrading. <br />b. Salmi~Smd~: The pernrittee must submit a report addressing salinity by December 31, 2006. Because there is no record that <br />e pth ermittee has previously submitted this report, a compliance schedule is included for the performance of the study. <br />However, if a report has previously been submitted, the pennittee should submit a copy of this report in lieu of the performance <br />of another study, <br />B. MONITORING REQUIREMENTS <br />1. Frequencv and Sample Tyke <br />• <br />In order to obtain an indication of the probable compliance of noncompliance with the effluent limitations specified in Part LA.1, the <br />permittee shall monitor all effluent parameters at the following frequencies. Such monitoring will begin immediately and last for the <br />life of the permit unless otherwise noted. The results of such monitoring shall be reported on the Discharge Monitoring Report form <br />(See Part IPE.). <br />a.
