Effluent Limitations <br />Beginning no later than the effective date of this permit and lasting through the expiration date of the permit, the permittee is <br />authorized to discharge from outfatls 001A through OlOA the discharges from sedimentatron ponds--all prior to entering state <br />waters. <br />In accordance with the Water Quality Control Commission Regulations for Effluent Limitafions, Section 62.4, and the Colorado <br />Dischazge Pemrit System Regulations, Section 6].8(2), 5 C.C.R. 1002-61, the pemritted discharge shall not contain effluent <br />parameter concentrations, whrch exceed the following lunitations specified below or exceed the specified flow lunitation. <br />a. Alternate Limitation Burden of Proof Requirements <br />• The pemvttee has the burden of proof when seeking relief from total suspended solids (TSSI, total or total recoverable iron, and/or <br />settleable solids (SS) limitations, as applicable. All Outfalls are eligible for relief from''If`SS, or total recoverable iron, and SS; <br />however, the majority of [he loading from any dtschargge has to consist of storm runoff for the relief to be available. The ppemvttee <br />will need to show that exceedence of the applicable limitations was caused by precipitation and not mine water, through a <br />comparison of the loading from each source. Relief maybe granted for each discharge occurrence only when necessary and shall not <br />be granted when the permittee has control over the discharge. The pet-mittee should endeavor to meet [he primary limitations <br />whenever possible. <br />Revised 1242005 <br />
