Effluent Limitations <br />Beginning no later than the effective date of this pemut and lasting through the expiration date of the pemrit, the permittee is authorize[ <br />to discharge from outfalls OOlA through OlOA the discharges from sedimentation ponds--all prior to entermg state waters. <br />In accordance with the Water Quality Control Commission Regulations for Effluent Limitations, Section 62.4, and the Colorado <br />Discharge Permit System Regulations, Section 61.8(2), 5 C.C.R. 1002-61, the permitted dischar a shall not contain etlluent parameter <br />concentrations, which exceed the following limitations specified below or exceed the specifiedgflow limitation. <br />a. Alternate Limitation Burden of Proof Requirements <br />The permittee has the burden of proof when seeking relief from total suspended solids (TSS), total or total recoverable iron, and/or <br />settleable solids (SS) limitations, as applicable. All utfalls are eligible for relief from T S, or total recoverable iron, and SS; however, <br />the maJority of the loadingg from any discharge has to consist of storm runoff for the reliefto be available. The permittee will need to <br />show that exceedence ofthe applicable limitations was caused by precipitation and no[ mine water, through a comparison ofthe loading <br />from each source. Relief may be granted for each discharge occurrence only when necessary and s all not e granted when the <br />permittee has control over the discharge.
