Said proof shall be submitted as an attachment to the Discharge <br />Monitoring Report (DMR) for the appropriate period. The Division shall determine the adequacy of proof. As part of tht: <br />detetminatton, the Drvtsion shall evaluate whether the petmittee could have controlled the discharge in such a manner that priman <br />limitations could have been met. All manual dewatering of ponds that are equipped with automatic dewatering systems must meet TSt <br />and total iron limitations. If a pond has only manual dewatering capability, relief is available only to the extent required to regair <br />necessary stability and capactty. <br />3. Post-Minine Areas <br />In conformance with 40 CFR 434.50, commencing at the time active mining has ceased and all surface areas served byy a sedimentatioc <br />and have been returned to the required contour and revegetation has commenced, applicable dischazges may be eligible for post-minim <br />Pmitations. Inmost cases, these post-mining limitations shall remain in effect until bond release. The petrmttee shall notify the Division <br />at the appropriate time so that consideration of permit modifications can be made. Prior to nottficahon and subsequent permit <br />modificafion, active mining limitations will apply regardless of actual mine status. <br />4. Compliance Schedule <br />a. Salinity Study: The petmittee must submit a report addressing salinity by December 31, 2006. Because there is no record [hat the <br />permittee has previously submitted this report, a compliance schedule is included for the performance ofthe study. However, if a <br />report has previously been submttted, the petmittee should submit a copy ofthis report in lieu ofthe performance of another study. <br />B. MONITORING REQLJIItEMENTS <br />• 1. Frequency and Sample Type <br />In order to obtain an indication of the probable compliance or noncompliance with the effluent limitations specified in Part I.A. I ,the <br />permittee shall monitor all effluent parameters at the following.frequenctes. Such monitoring will begin immediately and last for the life <br />of the ppermit unless otherwise noted. The results of such monitoring shall be reported on the Discharge Monitoring Report form (See <br />Part I.E.). <br />a.
