<br />EXHIBIT D <br /> <br />THE FORT LYON CANAL COMPANY <br />RECLAMATION PERMIT APPLICATION <br />MINING PLAN <br />Mining will be byfront-end loader. There will be no water diversions or embankments. <br />The size of the area to be mined at any one time will not exceed 10 acres. The approximate <br />time table for the mining operation will be twenty years. It is anticipated that an existing lease <br />will be renewed for five years with the Colorado State Land Board. As each area is mined, <br />Applicant will begin reclamation procedures on the mined out premises. The limestone and <br />rock is within a few feet of the surface, and top soil will be stock piled for future reclamation. <br />No secondary commodities will be utilized. The use of the limestone and rock will be for canal <br />maintenance on Applicants property and there will be no sale to third parties. No explosives <br />will be used for mining. <br />
