<br />Adequacy Issues 3 February 19, 1999 <br />Delta Paving Gravel Pit File No. M-98-105 <br />4. Exhibit D -Mining Plan (al The mining plan indicates that mining will commence in <br />the phase I area and that two phases may be affected at any given time. However, the <br />mining plan does not indicate the sequence of mining for the different phases. Pursuant to <br />Rule 6.4.4(e)(iii), please clarify the sequence of phases to be mined. <br />Ib) The application indicates that material crushing and washing, and production <br />of asphalt and concrete products will occur in the processing/stockpile area. Such <br />activities generally require on-site storage and utilization of fuels, lubricants, and other <br />potentially hazardous contaminants. Uncontrolled surface drainage, processing water and <br />fluid spills from such an area could transport excessive sediment loads, petroleum products <br />and other pollutants and degrade surface and/or groundwater systems. Rule 3.1.6 requires <br />that the operator take appropriate measures to minimize disturbances to the prevailing <br />hydrologic balance of the affected land and of the surrounding area and to the quantity or <br />quality of water in surface and groundwater systems both during and after the mining <br />operation and during reclamation. Rule 3.1.5(11) states that no unauthorized release of <br />pollutants to groundwater shall occur from any materials mined, handled or disposed of <br />within the permit area. Please describe how the operator will control surface drainage, <br />processing water and fuel/lubricant/chemicals storage areas to minimize hydrologic impact. <br />Please show the locations of the containment and control structures on Exhibit C, Mining <br />Plan Map. <br />(c) The application indicates that excavation areas will be dewatered and that <br />settling pondls) may be required depending on the silt content, prior to discharge to the <br />Gunnison River. Pursuant to Rule 6.4.4(c), please describe the sediment pondls) and show <br />the location(s) on Exhibit C, Mining Plan Map. <br />Id- Colorado Division of Wildlife (DOW) has recommended that the material <br />processing site be located as far away from the river and riparian vegetation as possible <br />and that the permanent ponds be located above the 50 year floodplain. Please clarify how <br />the application has addressed DOW recommendations. <br />Ie1 Rule 6.4.41h) requires that the application name and describe the intended use <br />of all expected incidental products. As noted under adequacy issue 1 above, the <br />application form indicates 70,000 tons/year of incidental commodities. Please name and <br />describe the intended use of the 70,000 tons/year expected incidental products. <br />5. Exhibit E -Reclamation Plan la) The reclamation plan does not address application <br />of fertilizer for areas to be topsoiled and revegetated, as required by Rule 6.4.5(2)(f)(iii). <br />Please address. <br />Ibl The application indicates that revegetation of the phase II pond area, located <br />above the expected water elevation, will not be attempted.
