<br />Adequacy Issues 2 February 19. 1999 <br />Delta Paving Gravel Pit File No. M-98-105 <br />3. Exhibit C -Mining Plan Map (a) The permit boundary does not appear to be clearly <br />labeled. Please clarify whether the feed lots, located on the far east side of the stockpile <br />area and mining phase VI, and the field owned by Delta Paving LLC and located in portions <br />of the NW 1 /4 of Section 10 and SW 1 /4 of Section 3 and west of phases I, III and VII, are <br />within the permit boundary. Pursuant to Rule 6.2.11d) and 6.4.3(d), please revise Exhibit <br />C, Mining Plan Map, to clearly delineate and label the permit boundary. <br />(b) Exhibit C does not show access roads for the phase II and VIII areas. The <br />application text does not address access for phase VII. The application text indicates that <br />phase II will be accessed by fording the drainage canal during low water season. A low <br />water crossing of a canal, at a location not previously improved for heavy equipment, may <br />result in "affected lands", as defined by Rule 1.113). Please revise Exhibit C to show <br />access to the phase 11 and VIII areas and revise the acreage of affected Lands to include the <br />new access roads, if necessary. <br />(c) Rule 6.4.3(g) requires that Exhibit C show the owner's name for any <br />permanent man made structure contained within affected lands and within 200' of affected <br />lands. Pursuant to Rule 6.4.3(g) please revise Exhibit C to show the owner's name for the <br />following structures: <br />Drain Ditch located between phases VIII and III, and continuing along the west <br />sides of phases III, I and VII. <br />Drainage Canal located between phases II and the processing/stockpile area, <br />and continuing along the north side of phase IV. <br />Feed Lots and Building located east of phase VI and the processing/stockpile <br />area. <br />Power line crossing portions of the proposed 24' wide haul road. <br />Existing access roads and fence lines within affected areas or within 200' of <br />affected lands. <br />(d) Pursuant to Rule 6.4.31e), please revise Exhibit C to portray the types of <br />present vegetation covering phase II, IV and VII, and the processing/stockpile area. <br />(e) The application states that wetlands exist in the phase IV area. <br />Correspondence from the US Army Corps of Engineers iCOE), dated 1/27/99, also <br />indicates that wetlands are located within the pit boundary. Pursuant to Rule 6.4.3(e), (f) <br />and (hl. please revise Exhibit C to delineate the wetland areas. <br />
