Pursuant to Rule 1.4.5(31, DMG decision date has been set for 415199. <br />DMG has received a written objection to the application. Therefore, pursuant to Rule <br />1.7.4(21, a Formal Public Hearing before the Colorado Mined Land Reclamation Board has <br />been scheduled for April 28-29, 1999. Additionally, DMG will schedule an Informal <br />Conference, to occur subsequent to the close of the public comment period, and aPre- <br />Hearing Conference, to occur no sooner than 10 days following the decision date but at <br />lease 5 working days prior to the Board hearing. Specific dates, times and locations for <br />the public meetings and hearing will follow under separate mailing. <br />DMG review of the Delta Paving Gravel Pit application has identified the following <br />adequacy issues. Please be advised that the application may be deemed inadequate and <br />may be denied on 4/5/99, unless the following adequacy review items are addressed to the <br />satisfaction of DMG. <br />1. Application Form Item 5 of the application form requests that the applicant identify <br />the primary and incidental commodities to be mined. If sand and gravels are the primary <br />commodities, please indicate such in the space provided on the form. Please identify the <br />70,000 tons/year of incidental commodities indicated under item 5.1, and identify the <br />anticipated end use of the incidental commodities under item 5.3. <br />2. Exhibit A -Legal Description The legal description indicates that proposed affected <br />lands are located in portions of the NW 1/4 of Section 10. However, under item 9 of the <br />application form and on Exhibit B -Index Map, the NE 1/4 of Section 10 is indicated. <br />Please clarify and correct if necessary. <br />
