The Delta Paving Gravel Pit application was found complete for the purposes of filing on
1/4(99. Pursuant to Rule 1.4.5(31, DMG decision date has been set for 415199.
DMG has received a written objection to the application. Therefore, pursuant to Rule
1.7.4(21, a Formal Public Hearing before the Colorado Mined Land Reclamation Board has
been scheduled for April 28-29, 1999. Additionally, DMG will schedule an Informal
Conference, to occur subsequent to the close of the public comment period, and aPre-
Hearing Conference, to occur no sooner than 10 days following the decision date but at
lease 5 working days prior to the Board hearing. Specific dates, times and locations for
the public meetings and hearing will follow under separate mailing.
DMG review of the Delta Paving Gravel Pit application has identified the following
adequacy issues. Please be advised that the application may be deemed inadequate and
may be denied on 4/5/99, unless the following adequacy review items are addressed to the
satisfaction of DMG.
1. Application Form Item 5 of the application form requests that the applicant identify
the primary and incidental commodities to be mined. If sand and gravels are the primary
commodities, please indicate such in the space provided on the form. Please identify the
70,000 tons/year of incidental commodities indicated under item 5.1, and identify the
anticipated end use of the incidental commodities under item 5.3.
2. Exhibit A -Legal Description The legal description indicates that proposed affected
lands are located in portions of the NW 1/4 of Section 10. However, under item 9 of the
application form and on Exhibit B -Index Map, the NE 1/4 of Section 10 is indicated.
Please clarify and correct if necessary.
