q) The applicant may be required, if determined to be necessary by the <br />authorized BLM officer, to mitigate the loss of big game habltai due to <br />construction by modification of up to 25 acres of pinyon-juniper woodland to <br />mountain shrub community. <br />r) The lessee shall utilize and operate all facilities and devices in accor- <br />dance with all applicable air quality standards and related plans of imple- <br />mentation adopted pursuant to the Clean Air Act, (77 Stat. 392 as amended, <br />42 U.S.C. 1857) as now in effect or as hereafter amended, or if it should be <br />superseded, the statute superseding it, and applicable State standards. <br />1. During periods of construction and operation activity, the lessee will <br />institute a watering program for dust suppression. <br />2. Upon completion of construction, the lessee will rapidly reclaim areas <br />not subject to continuing disturbance by means of chemical stabiliza- <br />tion, grading, and planting of vegetation. <br />3. Hydrocarbon (HC) emissions devices will be required on all vehicles, in- <br />• cluding off-road vehicles utilized in connection with the lessee's oper- <br />ations. <br />s) In order to ensure compliance with the Environmental Protection !Agency (EPA) <br />noise regulations and guidelines, the lessee will: <br />1. Quarterly assess community noise during construction and semiannually <br />thereafter until the noise appears to stabilize statistically. <br />2. Assess dominant noise sources if significant changes occur in the opera- <br />tions. <br />3. Periodically, as scheduled with the District Manager, measure dominant <br />noise levels of major components of the facility subject to wear, in- <br />duced noise fluctuations (i.e., crusher, conveyor, loadout facility, <br />etc.). <br />• <br />
