1) Cutting of snags will be prohibited except within the actual disturbed area <br />required for construction, to minimize the loss of perches and nesting trees <br />for raptors, insectiviorous birds and cavity nesters. <br />m) Construction activities, including but not limited to heavy equipment, heli- <br />copters and blasting will be prohibited by the grantee within 1000 fee[ of <br />the golden eagle nest from March 1 to July 1. <br />n) Construction activity will be prohibited within the critical wintering area <br />during the period when deer and elk are concentrated (usually December 1 to <br />April 15). In light winters, the authorized BLM officer may grant permis- <br />sion [o work after consultation with the Division of Wildlife (DOW). <br />o) After initial construction on the rights-of-way is completed, the grantee <br />will limit activities other than on the mine site and mine access roads to <br />the daylight hours between December 1 and April I5. In emergency situa- <br />tions, following consultation with DOW, an authorized BLM officer may allow <br />additional access. <br />• The grantee will prohibit public access to all permanent and temporary roads <br />and trails between December 1 and April 15. <br />p) DOW and BLM will monitor road kill losses to deer and elk along Stevens <br />Gulch Road. If the losses exceed 10 animals per winter, the applicant will <br />be required to implement some combination of the following mitigating mea- <br />surest <br />1. Reduce traffic on Stevens Gulch Road from dusk to dawn through busing or <br />adjustment of work shifts; <br />2. Reduce the speed of trucks and workers on the road; <br />3. Light the problem areas along the road (lights must be designed [o mini- <br />mize visibility from Highway 133 and Paonia). <br />• <br />
