• <br />8. The mined area appears to be located in and along Brunker Creek. The applicant will need to specify <br />the periods of flow in Brunker Creek and describe how the mining operation will minimize the <br />impacts to the surface water in the creek. Specifically, please explain how much of the creek will be <br />mined, how will flow be directed around the mining operation and how will the runoff be controlled <br />to ensure mine material and waste is not directed into the creek. The applicant should also describe <br />periods when mining will be avoided due to seasonal fluctuations in the creek. <br />9. The applicant will need to indicate how close the mining operation will be to structures located on the <br />site. The applicant will need to specifically state how close the pit excavation, roads and topsoil piles <br />will be to permanent man made structures such as homes, roads, wells, utility lines, etc... Please be <br />aware that if mining is to occur within 200 feet of any permanent man made structure, the applicant is <br />required to either; <br />• Provide a notarized agreement between the applicant and the owner of the structure that the <br />applicant is to provide compensation for any damage to the structure; or <br />• Provide an appropriate engineering evaluation that demonstrates that such structure shall no[ be <br />damaged by activities occurring at the mining operation. <br />10. Please specify the dimensions of any new or existing roads that will be used for the mining operation. <br />Any improvements necessary on existing roads or new roads must contain specifications used in the <br />construction (length, width, road material, etc...). Please also state if the roads will be reclaimed <br />once mining is complete. Please address accordingly. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />I I. The applicant refers to a reclamation plan prepared by the USDA Natural Resources Conservation <br />Service. Washington County will need to commit in writing to all or a portion of the reclamation <br />suggestions noted in the report. Please address accordingly. <br />12. The USDA report recommends that 1 foot of topsoil be removed. Please state the depth of topsoil to <br />be replaced on the reclaimed lands. <br />13. The USDA report recommends that reclaimed slopes be graded to 2h:1 v. Rule 6.3.4(1)(b) requires a <br />justification that supports steeper slopes for the proposed post-mining land use for all slopes steeper <br />than 3h:1 v. The applicant proposes apost-mining land use of pastureland, which is not conductive to <br />2h: l v slopes. The applicant will need to further explain to what slopes the pit will be reclaimed to <br />achieve the end land use of pastureland. <br />14. The USDA report states the permit area to be 280 acres. Page 1 of the application states 270 acres <br />will be permitted. Please clarify this discrepancy. <br />15. Please explain how Brunker Creek will be reclaimed once mining is complete. Specifically, the <br />applicant will need to provide across-section of the drainage (pre-mining and post mining), explain <br />how the channel and slopes will be protected from water erosion, and provide a seeding or rock <br />armoring plan if necessary. <br />16. Please describe the methods of weed control that will be employed for all noxious weed species on <br />site. The applicant will need to include a mitigation plan to control all noxious weeds and plan of <br />implementation in the event a weed problem exists. <br />Rule 6.4.5 Exhibit E- Reclamation Plan Map <br />17. Exhibit F does not adequately portray the proposed topography with contours in sufficient detail to <br />determine the direction and rate of slope of the reclaimed lands. Please revise the map to include <br />contour lines of the reclaimed slopes and the reclaimed drainage channel. <br />
