• <br />I8. The reclamation plan map includes 6 topsoil piles. If the topsoil is to be used for reclamation, then <br />the piles should not be included on this map. Please correct this discrepancy. <br />Rule 6.4.7 Exhibit G- Water Information <br />19. Please explain how mining in and around Brunker Creek will impact the quality and quantity of <br />surface water. [n addition, how will mining in the creek be managed to ensure surface and <br />groundwater impacts are minimized. <br />20. Exhibit C includes the location of a well within the affected land. The map included in Exhibit I <br />titled, "Conservation Plan Map" includes a well, but in a different location. Please indicate in [he <br />application if both wells exist on site. In addition, please state the depth of the well, completion <br />information on the well, and how the wells will be protected from mining and reclamation. Please be <br />aware that if mining is to take place closer than 200 feet to the wells, the requirements noted in <br />question #22 must be addressed. <br />Rule 6.4.13 Exhibit M- Other Permits & Licenses <br />2l. The applicant will need to specifically state other permits that will be obtained for this mining <br />operation. For example, a County Special Use Permit, Air Emissions Permit, NPDES Permit, etc... <br />Rule 6.4.19 Exhibit S- Permanent Man-Made Structures <br />22. On Exhibit C the applicant depicts a number of permanent man-made structures. The applicant will <br />need to state who owns the structure and specify any mine off set distances from all of the structures. <br />All off set distances will need to be marked in the field. Please be aware that if mining is to occur <br />within 200 feet of any permanent man made structure, the applicant is required to either; <br />• Provide a notarized agreement between the applicant and the owner of the structure that the <br />applicant is to provide compensation for any damage to the structure; or <br />• Provide an appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />23. The applicant provided a letter from Y-W Electric Association, lnc. regarding protection of structures <br />located on the permit area. This letter does not adequately address protection of structures required <br />by the rules and regulations. This letter only requires notification to Y-W Electric prior to mining in <br />the area. Please refer to question #22 for what is required to ensure the power poles and lines are <br />protected. <br />Please be advised that Shook Gravel Pit # l New Permit Application may be deemed inadequate, and the <br />application may be denied on May 30, 2001 unless the above mentioned adequacy review items are <br />addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the <br />Division can grant an extension to the decision date. This will be done upon receipt of a written waiver of <br />your right to a decision by May 30, 2001 and request for additional time.
