grading the area, a sampling program will be initiated to follow <br />• recommendations of the Division. <br />Peerless Resources, Inc. now plans to place approximately 6 to 12 inches <br />of plant growth material over the graded area, the soil testing plan for <br />evaluation of the seed bed at the mine site will not change. Peerless <br />Resources, Inc. will still plan to sample the plant growth material for <br />nitrate nitrogen, organic matter, phosphorus, and potassium. Based on <br />the analyses o'. the soil samples, the final recommended rates for <br />fertilization will be determined. Prior to the implementation of any <br />fertilization, Peerless Resources, Inc. will contact the Division for <br />approval. <br />Sealing of Exploration and Mine Holes <br />The details of portal closure and elimination of drill holes is set <br />forth at the start of this Section. <br />• Water and Air Quality Control Techniques <br />Steps to be taken to comply with the Clean Water Act and other <br />applicable water quality laws and regulations and health and safety <br />standards including a comprehensive drainage and sediment control plan <br />are described in Sections 2.05.3 and 4.01.5 through 4.05.18. With <br />respect to the compliance with the Clean Water Act, Peerless Resources, <br />Inc, has requested a discharge permit from the Colorado State Department <br />of Health under the National Pollutant and Discharge Elimination System <br />(NPDES). Compliance with this permit serves to effect compliance with <br />the Clean Water Act and the Colorado IJater Quality Control Act. A copy <br />t:9 T;ubm is presented in Exhibit 3, Permits for Mining. <br />Peerless Resources, Inc. has likewise submitted a request of <br />applicability for air quality emissions permit to the Colorado <br />Department of Health, Air Quality Division. Fugitive dust control <br />measures are employed as an integral part of the activities at the <br />• surface facilities. Compliance with this permit will serve to effect <br />MpR 0 4 19~ <br />2.05-35 <br />
