Additional Hydrological, Geological, Engineering or Other Information: <br />When specific evidence suggests undesirable subsurface conditions exist, additional <br />hydrological, geological, engineering or other information provided by a Registered <br />Professional Engineer or Professional Geologist may be required to be submitted by <br />the applicant. This requirement shall not prejudice the right of the local heahh <br />department to develop it's own information from it's own sowce. <br />E. All systems must be installed, altered or repaired by a systems contractor licensed in <br />Gilpin County in accordance with Section 3.07 of these Regulations. <br />3.03 Access to Site <br />For the purpose of inspection and enforcing applicable Hiles and regulations and the terms and <br />conditions of any permit issued, the health officer or his/her designated representative is <br />authorized to ewer upon private property at reasonable times and upon reasonable notice for <br />the purpose of determining whether or not operating individual sewage disposal facilities and <br />systems are functioning in compliance with the applicable rules and regulations adopted <br />pursuam ther~o and the terms and conditions of any permit issued and to inspect and conduct <br />tests in evaluating any permit application. The owner or occupant of every property having <br />an individual sewage disposal system shall permit the health officer or his/her designated <br />representative access to the property to conduct requved tests, take samples, monitor <br />compliance, and make inspections. <br />3.04 Denial of Permit: Appea/ <br />A. Appeal from Health Officers Decision to the Board of Health: <br />In the event the health officer or his/her designated representative denies an <br />application, written notice of the denial of the permit shall be given to the applicant <br />by certified mail, return receipt requested. Any applicant who is denied a permit may <br />appeal to the local boazd of heahh Such an appeal must be filed with the local health <br />department, in writing, within thirty (30) days after the notice of denial has been <br />mailed. Upon finding that the health officer or his/her designated representative erred <br />in his denial of a permit, the local boazd of health shall approve the permit. Upon <br />finding that strict enforcement of these regulations would cause undue hardship to the <br />applicant, and upon fiuther finding that non-compliance with these regulations would <br />not be injurious to public health, or the environment, or be less restrictive than the <br />state guidelines, the local board of heahh may authorize issuance of a permit despite <br />noncompliance. In such cases, the burden of proof is upon the applicant to show that <br />the system wt71 not injwe adjacent properties, will not conflict with the purposes of <br />these regulations, and will not adversely affect the health of any person or the <br />15 <br />_. <br />
