Many of <br />the minor problems that are created by rock quarrying aze the same as those found in <br />rural azeas associated with agricultural practices. <br />4. That the proposed conditional use will not result in overly intensive use of the <br />land relative to use of the surrounding land. <br />The M.L.RB. permit states this quarry will operate year around with periods of inactivity <br />when adverse weather conditions exist This is a simplified explanation that addresses <br />requirements in the State permit regarding Temporary Suspension of the operations. The <br />activity level is fairly similaz to that associated with agricultural activities. During the warm <br />months activities increase while in colder months activities reduce. This quarry will not <br />signi&carrtly increase the activity on the surrounding area. <br />The material from this quarry will be for building houses, businesses and landscaping. <br />Our records show that approximately 6,000 tons of material will be removed each yeaz <br />from the quarry. <br />• 5. That the proposed conditional use will not result in traffic congestion or <br />hazards to vehicular or pedestrian traffic. <br />As noted above, a nrinor traffic increase is expected if this proposal is approved. At this time <br />trucks hauling moss rock from the surrounding area have been using the roads over the past 3 <br />years. Since most of the supply of moss rock has been depleted, the trucks hauling from the area <br />will shift to this quarry when all approvals are completed There will not be an increase in trucks <br />using the county roads in this area under our proposal nor will those tucks result in increased <br />traffic congestion. See EXHIBIT 2 regarding the tnrck impact analysis for more information. <br />6. That the proposed conditional use will not unnecessarily scar the land on <br />which such use would be located and that the Site is free from loose piles <br />ofsoil or other materials and open, unprotected pits or holes. <br />There are many state regulations that deal with this issue. The state reclamation law <br />(CRS 3432.5-100 et seq.) provides the necessary guidance to assure mines are reclaimed. <br />EXHIBIT 4 contains the state mining and reclamation• plans proposed to mitigate any <br />scaring of the hillside. We might pohrt out that quarry operators are required to reclaim the <br />disturbed area of a quarry unlike many adjoining land owners. If a cut is made in a land, it has <br />to be sloped and revege[ated to at least existing conditions so as to make it blend in with the <br />surrounding area. The quarry operator has to post a bond calculated by the M.L.R.B. to <br />Yoram Stone LLP assures the reclamation is completed as approved <br /> <br />
