<br />Attachment 12 <br />page 8 <br />EXHIBIT 3-SECTION ll-COMPLIANCE <br />• Zoning resolution Section 3.06.02 - t thru 7 <br />1. That the proposed conditional use conforms to the requirements an <br />resolution, <br />The Las Animas County zoning resolution (3.05.59) indicates that rock quarrying <br />Is a Conditional Use in all zone districts? We surmise that the commission approved <br />this section to better plan for and allow rock quarrying in an Agriculture (A) zone <br />district. This document has been prepared in conformance with and using the Zoning <br />Resolution as a guide. <br />2. That the proposed conditional use is consistent with the goals, objectives <br />and policies of Las Animas County as contained in Section II of this <br />Guide. <br />We have reviewed Section II- The Comprehensive Plan and find that while there is <br />no way every proposal could comply with all policies in the guide; it does provide a <br />good base when planning a proposed use. We have chosen to point out those goals that <br />support our proposed conditional use feeling that our plan mitigates those sections that <br />aze contrary to a stated policy or goal. It is important to remember that limestone is a <br />basic building material used by all citizens in the county, state and nation. Also, that <br />limestone is only available where nature deposited it. Society does not have the luxury <br />of fmding limestone where it would like it to be, it is only available where it was <br />deposited. <br />• The county chooses to recognize development of natural resources in the following <br />parts of Section II, 2.07.2 Paza 2; 2.07.3 Paza 1, 2, & 3; 2.08.03; 2.11.01.02, &.OS <br />and 2.11.02.01. The consensus is to encourage development of a resource for the <br />benefit of the citizens of Las Animas County. Section 11 encourages an applicant to <br />mitigate impacts that may occur and we feel the quarrying and reclamation plan we <br />have submitted to the state will mitigate any short term negative impacts created by <br />quarrying. The state statutes require that the lands be reclaimed so they have a <br />beneficial use for the land owner and state citizens. <br />There aze numerous sections regazding employment opportunities and increasing <br />the income of county citizens. <br />The sections regarding building improvements would also benefit from this quarry <br />since the rock will go to provide building material for private homes and businesses, <br />in the immediate vicinity of the quarry and lower the cost to local citizens that may <br />need building or landscaping material. <br />3. That the proposed conditional use is consistent with and in harmorry with <br />neighboring land uses and future intended land uses in the area. <br />The proposed quarry location meets this goal. At this time the site is far from <br />residential areas. The closest house is 3 miles from the quarry. The zoning resolution <br />indicates that a rock quarry is a Condifional Use in an Agriculture zone district, <br />seeming to indicate that rock quarries aze consistent with and will be in harmony with <br />the neighborhood. Ranching is the primary use surrounding the proposed mine site. <br />• Since quarrying impacts fewer citizens and is less intrusive in Agriculture zone <br />
