Attachment 12 <br />page 10 <br />• EXHIBIT 3- SECTION 11-COMPLIANCE <br />JULY 17, 2007 <br />When quarrying is complete, the area will be reclaimed for use as rangeland. Rock <br />stockpiles will exist on the site but these will rat be susceptible to wind erosion. During <br />quarrying any soil piles will be temporarily seeded to protect them from erosion until <br />needed for reclamation. There will be no open pits or holes left when quarrying is <br />done. <br />7. That the proposed conditional use will not be likely to prove detrimental <br />to the public health, safety or welfare of neither county residents nor <br />cause hardship for neighboring persons. <br />The location of this site is such that it's isolated location and restricted access will <br />insure that it will not adversely affect the public's health, safety or welfare. The <br />quarry will be located nearly 1/4 mile from the closest neighbor property line. The <br />entrance of the quarry is a pasture road off of County Road 223. Anyone entering the <br />quarry would be trespassing. As mining progresses azound the property, the floor of <br />the quarry will be lower than the surrounding area helping to shield it from off site. <br />This decreases the impact the mining activities will have on the surrounding land <br />Current laws assure that the mine will be operated in a safe and healthy manner. <br />Air. Pollution laws require that the mine operates in a manner so that dust emissions <br />• are within state standazds. Usually the dust created each day at a rock quarry is less <br />than that generated on a typical gravel road during the same time period and dust <br />control measures aze used at the mine to reduce the emissions. <br />Other governmental agencies will also monitor this rock quarry during its life. The <br />Colorado Division of Reclamation, Mining and Safety will review a permit necessary <br />to quarry and reclaim the site. They also do inspections to make sure the quarry is in <br />compliance with state law and the approved permit. Their regulations assure the site is <br />reclaimed to at least its present condition so that once reclamation is complete; the only <br />evidence that the azea was mined will be a minor change in land form. An Air Pollution <br />Emissions Notice permit will be obtained from the Colorado Department of Health <br />(CDOH). This permit will address how we will control dust that may be created by the <br />mining operation. We will use best management practices (BMPs) at all times to <br />preserve and restore the environmental harmony with the surrounding properties. <br />The Mine Safety and Health Administration (MSHA) governs mine safety and <br />miner health at the quarry. They inspect the site regulazly to make sure it is operating in <br />a safe manner and as permitted. Their regulations determine the activities that are <br />allowed at the quarry and regulate all safety standazds from equipment operation to <br />quazrying. <br />r <br />
