• 2.06.5 <br />• <br />As per Rule 4.14.2(2)(b) -The vertical distance between terrace <br />benches was not specified by the Division. The vertical distance <br />between benches at the Bowie No. 1 Mine should have an <br />insignificant affect on erosion control or stability. Map 6A-SC, <br />Reclamation Zones, presents the vertical distance between <br />road/terrace benches. <br />(b) There are no land use planning agencies in Delta County <br />therefore, no consultation with the appropriate land-use <br />agencies is possible. The Land Use Appendix, Volume 9, <br />presents a letter from the BLM indicating the postmining <br />land use of wildlife habitat and rangeland are acceptable to <br />the BLM, as the agency responsible for managing the <br />adjacent lands. <br />(c) The applicant has demonstrated compliance with the <br />requirements for acceptable alternative post-mining land <br />uses of Section 4.16 in permit Section 2.05.5. <br />(d) The demonstration that the watershed of lands within the <br />proposed permit area and adjacent areas will be improved <br />by the operations is presented beginning on page 4i. <br />The Division's approval of this plan will constitute <br />appropriate State environmental approval. <br />(e) The land owners of record (Section 2.03.4) have requested <br />that the surface area be useable primarily for grazing, upon <br />final abandonment. This post-mining land use is consistent <br />with historic and adjacent land uses. See Section 2.05.5 - <br />Post-Mining Land Uses. <br />The owners of the surface have requested in writing, as part <br />of this application, that a variance from approximate original <br />contours be granted.
