2.06.5 <br />(f) The applicant has demonstrated that the operations are <br />being conducted in compliance with the requirements of <br />4.27.4 (refer to the Final Abandonment Appendix, Volume <br />6A). <br />(g) All other requirements of the Act, these rules and the <br />regulatory program are being satisfied by the applicant. <br />(3) The applicant requests the variance be reviewed by the Division before <br />each permit renewal and not later than the middle of each permit term. <br />(4) The applicant will be able to demonstrate compliance with 2.06.5(3) <br />during final reclamation. Reclamation operations which involve an <br />approximate original contour variance will not be performed at any other <br />time. <br />(5) If the Division or Board determines that more stringent measures are <br />necessary to ensure operations are conducted in compliance with the <br />requirements of this Act and these Rules, the applicant will respond. <br />• (6) The applicant understands that upon Division approval of the variance, <br />the requirements of Rule 4.27 are a specific condition of this permit and <br />this permit shad be specifically marked as containing a variance from <br />approximate original contour. <br />TR 96-028 4 Rev. 4!27/98 <br />TR-2.8/R~v-o 3 <br />/i PPROOcO 12// 4/9 `/ <br />
