• §2.06 REQUIREMENTS FOR PERMITS FOR SPECIAL CATEGORIES OF <br />MINING <br />2.06.5 Permits Incorporating Variances from Approximate Original Contour <br />Restoration Requirements for Steep Slope Mining. <br />(1) The applicant requests a variance from the Division regarding <br />restoration of the Bowie No. 1 Mine to approximate original <br />contours. The applicant believes that this variance will enhance <br />post-mining productivity of the affected area. <br />No variance for the West Mine is necessary because approximate <br />original contours will be restored. <br />(2)(a) At the Bowie No. 1 Mine, the access road will enhance the post- <br />mining land use of rangeland by providing access to the ground. <br />The access road and its associated drainage system will also help <br />minimize erosion from the reclaimed area during the time <br />vegetation is becoming established. <br />Additionally, the access road on this site does not conflict with the <br />regulatory provisions for reclamation to approximate original <br />. contour. Rule 1.04(13) which defines approximate original contour <br />includes a provision for access roads. The definition specifies the <br />reclaimed area: <br />"closely resembles the general surface configuration of the land <br />prior to mining and blend into and complements the drainage <br />pattern of the surrounding terrain, with all highwalls, refuse piles, <br />and spoil piles eliminated." <br />The permit area North of Highway 133 is rugged mountainous <br />terrain with a few small undeveloped pastures and meadows. The <br />reclaimed mine site will have the same general surface <br />configuration as the surrounding area. The steeper reclaimed <br />slopes provide the rugged mountainous terrain. All surface <br />drainage from the mine site will continue to follow pre-mine <br />drainage patterns by flowing toward the North Fork of the <br />Gunnison River.
