• 2.06 RE7QDIItII~TPS FOR PERMITS FOR SPDCIAL (7(TTDODItIffi OF MII~X'. <br />2.06.4 BteEp Slope Minim. <br />(1) The provisions of Rule 2.06.4 are applicable to the mine bench and <br />portal areas of the Orchard Valley and Orchard Valley West Mines in <br />that these facilities are established on slopes exceeding 20°. <br />(a) COVCC does not propose to conduct surface coal mining and <br />reclamation operations which would leave a plain or pred~ninately <br />flat area, but on which an occasional steep slope is encountered as <br />the mining operation proceeds; <br />(b) COVCC has not obtained a permit for mountaintop rengval mining; <br />(c) OOVCC's mining permit contains a variance under idile 2.06.5 <br />applicable to the mine bench areas of the Orchard Valley Mine. To <br />the extent that these benches are covered by the variance, the <br />provisions of Rule 2.06.4 do not apply. <br />(2) 'ibis permit application contains sufficient information to establish <br />that the Orchard Valley Mine operations wvered by Rule 2.06.4 are <br />conducted in accordance with the steep slope performance standards in <br />Rule 4.27.3. The portals and benches at the Orchard Valley Mine were <br />constructed prior to the enactment of s+l(~2A. Design specifications <br />for the Orchard Valley West Mine are located in Volume 6, Phase III <br />• Stability Analysis Arrn~wrrlix. Reclamation plan specifications for the <br />Orchard Valley and Orchard Valley West Mines are located in Volume <br />6A, Reclaimed Configuration Appendix. Materials addressing the <br />variance for the Orchard Valley Mine are found in Volume 9, Larri Use <br />Appendix. <br />The Orclk-ir~d Valley West Mine portal bench was designed and <br />constructed in accordance with the performance standards specified in <br />lh~le 4.27. Urder the provisions of Rule 4.27.3(8) a mine bench cut <br />and mine bench fill design encompassing the temporary placeunPnt of <br />material on the downslope was developed by a qualified registered <br />professional engineer. The design provided the Division with a <br />thorough analytical demonstration that this alternative was as <br />environmentally sound and structurally stable as that resulting from <br />the requirement of Rule 4.27.3(1) which prohibits material from being <br />placed on the downslope. <br />In addition, the mine bench fill material placed on the downslope at <br />the Orchard Valley West Mine comprises a road embarilanent and support <br />facilities area designed and construc.-ted in conformance with the <br />requirements of Rules 4.03 and 4.04. The fill material was moved and <br />plaari in a controlled manner with construction certified by a <br />registered professional engineer. 'This placement of the fill on the <br />downslope is allowed under the provisions of Rule 4.27.3 (2). <br />. (3) OOVCC requests the Division to find, in writing, that in addition to <br />meeting all other requirements of the performance standards, the <br />Orchard Valley Mine operations will be conducted in accordance with <br />the requirements of 4.27.3. <br />MR 93-86 Revised 09/21/93 <br />lA <br />
