<br /> <br />(d) Robinson shall submit a narrative letter or <br />correspondence to the MLRB consistent with the terms of this <br />Agreement, describing in detail all changes to the original <br />Permit Application effectuated by the revised maps, Exhibits D-1 <br />and F, and by the revised Mining Timetable. <br />3. Mining, Reclamation and Related Covenants by <br />Robinson. <br />Sy entering into and executing this Agreement, and <br />submitting the amended maps described in paragraph 2 above to the <br />MLRB regarding the Permit Application, Robinson acknowledges the <br />following duties owed to Lakewood, and specifically covenants as <br />follows: <br />(a) Within the area designated as Mining Stage "2" <br />on Exhibit D-1 attached hereto, Robinson covenants as follows: <br />(i) Robinson shall not undertake or cause or <br />allow to be undertaken a Major Disturbance of more than 30.8 <br />total acres in Mining Stage "2." The remaining portion of land <br />within Mining Stage 2 may be subject only to Moderate or Minor <br />Disturbances. <br />(ii) Robinson shall assure that following the <br />completed reclamation of Reclamation Phase "2" the elevation of <br />the lands therein will not be lower than one five (5) foot con- <br />tour interval below that shown on Exhibit F. The lands may be <br />allowed to remain or be reclaimed at higher contour intervals as <br />long as all other requirements of the Permit Application are <br />satisfied, such as drainage and slope requirements. <br />(iii) Robinson shall not create or cause or <br />allow to be created any topsoil stockpile areas in Mining <br />Stage "2" except as specifically described and depicted on <br />Exhibit D-1. <br />(b) Within the area designated as Mining Stage "3" <br />on Exhibit D-1 and Reclamation Phase "3" on Exhibit F attached <br />hereto, Robinson covenants as follows: <br />(i) Robinson shall not undertake or cause or <br />allow to be undertaken a Major Disturbance of more than <br />10.0 total acres in Mining Stage "3"; provided, that for purposes <br />of this subparabraph, "Major Distrubance" shall be limited to <br />topsoil stockpiles and excavation in Mininq Stage "3" solely for <br />the purpose of obtaining "borrow" or "fill" material to be used <br />in completing reclamation in Reclamation Phase "2." The <br />remaining portion of land within Mining Stage "3" may only be <br />used for haul roads as necessary. <br />-3- <br />
